Terms of Service

These terms are not in force yet.

They were written by reading the source code and have not been reviewed by a lawyer. The highlighted blanks are facts only the operator can supply. Until they are filled in and the review has happened, treat this page as a statement of intent rather than an agreement you can rely on.

1 What this is

anvilyx is a Discord bot and web console for managing a Discord server, written and operated by OWNER: legal name (“the operator”, “we”). These terms are the agreement between the operator and you.

By adding anvilyx to a Discord server, by signing in to the console at app.anvilyx.com, or by using its features in a server that has it, you agree to these terms. If you do not agree, remove the bot or stop using it.

2 Discord’s terms apply on top

anvilyx runs on Discord. Discord’s Terms of Service, Community Guidelines and Privacy Policy govern your use of Discord itself and apply in addition to these terms. Nothing here overrides them. If these terms conflict with Discord’s, Discord’s govern your use of Discord.

You must have the right to install a bot in a server before you install it — in practice, Discord’s Manage Server permission and the server owner’s agreement.

3 It is free, and there is nothing to buy

anvilyx costs nothing. There is no paid tier, no subscription and no purchase of any kind. If that ever changes, these terms will be updated before it does, and any paid feature will be introduced through Discord’s own purchase mechanism where Discord requires it.

4 Your responsibilities

You are responsible for how your server uses these tools. anvilyx does what it is configured to do. The decision to delete messages, warn, timeout, kick or ban a member is your server’s, made through settings your server chose. The operator does not review those decisions and is not a party to them.

If you configure a server, you agree that:

If you are a member of a server that uses anvilyx and you object to how that server moderates you, take it up with that server’s moderators. They control the settings and can reverse any action. The operator does not overrule a server’s moderation decisions.

5 What we may do

The operator may, at any time and without notice:

Continuing to use the Service after a change means you accept the changed terms.

6 Ending it

You may stop at any time by removing the bot from your server. There is nothing to cancel.

Removing the bot does not delete your server’s data. Records are retained so that re-inviting the bot restores the server’s settings. To have data erased, ask — see the Privacy Policy. Sections 7, 8 and 9 survive the end of this agreement.

7 No warranty

The Service is provided “as is” and “as available”, with no warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose or non-infringement.

Stated plainly, because it matters: anvilyx is a personal project run by one person on a small server. It may be unavailable, it may lose data, it may act on a message it should not have acted on, and it may fail to act on one it should have. There is no uptime commitment, no support commitment and no guarantee that any feature will keep existing. The current state of the Service is at app.anvilyx.com/status.

Do not rely on anvilyx as your only record of anything you cannot afford to lose.

8 Limitation of liability

To the fullest extent permitted by law, the operator is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, of profits, of goodwill or of server membership, arising from your use of or inability to use the Service — whether or not the operator was told such damages were possible.

To the fullest extent permitted by law, the operator’s total liability to you for all claims relating to the Service is limited to OWNER: liability cap.

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud. Where you are a consumer, your mandatory statutory rights are unaffected.

9 Indemnity

You agree to indemnify the operator against claims, losses and reasonable costs arising from your use of the Service in breach of these terms or of the law — in particular claims by your own members about how your server used the Service’s moderation tools.

10 Data

How data is handled is set out in the Privacy Policy, which forms part of these terms. It states plainly what is stored, what is kept indefinitely, and how to ask for erasure.

11 General

These terms are the whole agreement between you and the operator about the Service. If a provision is unenforceable, the rest stands. Not enforcing a term is not a waiver of it. You may not transfer your rights under these terms; the operator may transfer them to a successor operating the Service.
